These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Agent") and Thunderbird Agency, LLC, which operates MaxMyListing and Best Home on Tour through its Agent Power Ups division ("MaxMyListing," "we," "us," or "our"). By creating an account, purchasing a plan or credits, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
MaxMyListing provides real-estate marketing infrastructure and done-for-you execution, which may include: listing descriptions, a single-property listing website with an optional custom domain, area and amenity content, MLS-oriented photo titles and descriptions, AI photo enhancement ("Photo MAXer") and virtual staging, listing videos and reels, agent-presented ("Agent Spotlight") videos, a social media plan and scheduling, print and QR materials, a seller-proof report, cross-promotion through the Best Home on Tour network, and a tracking dashboard.
We provide process, tools, infrastructure, and execution. We do not promise or guarantee any particular result — including views, impressions, leads, showings, offers, search rankings, traffic, engagement, or a sale. Real-estate outcomes depend on many factors outside our control.
You must be at least 18 and a licensed real-estate professional (or authorized to market the properties you submit). You are responsible for the accuracy of the information in your account and profile, for keeping your login credentials secure, and for all activity under your account. Accounts we set up on your behalf remain unclaimed until you sign in and confirm them.
One credit equals one listing's full marketing package. Credits come in three forms: monthly credits included with your plan, paid credits you purchase separately, and Remix credits — a protected, replacement credit we may issue when a listing situation outside your control (for example, a seller cancels) prevents a launch. Remix credits are used before paid credits. Unused credits roll over while your membership remains active.
Monthly plans are sold as recurring subscriptions at the prices shown at checkout and are billed in advance each month to the payment method on file, until cancelled. Plan credits and any included benefits are granted on each successful monthly payment. Prices, plan contents, credit amounts, and included benefits may change; changes apply to future billing periods, and we will make reasonable efforts to notify you of material changes. Some benefits (such as white-glove fulfillment, coaching, or included add-ons) are delivered as services and may be adjusted or scheduled at our reasonable discretion. Applicable taxes may be added.
Payments are processed by Stripe. We do not store your full card details. You authorize us and Stripe to charge your payment method for the plan and any purchases you make.
You may make one-time purchases, including additional credits and a Jumpstart bulk purchase to bring a set of existing listings up to date at once. One-time purchases are charged when you complete checkout, are applied as paid credits, and — except as required by law or expressly stated — are non-refundable once the associated work has begun.
We may offer promotional codes, coupons, founding-member benefits, member pricing, and bundled offers. These are optional, may be limited in quantity, time, or eligibility, cannot be combined unless we say so, have no cash value, and may be modified or discontinued. Founding and promotional benefits are tied to an active membership in good standing; if your membership ends, those benefits end with it unless we state otherwise in writing.
MaxMyListing memberships are generally offered on a 12-month basis, billed monthly. You may cancel at any time, which stops all future charges — you are not required to pay out the remaining months. Fees already paid are non-refundable. Any listing website already built remains live for as long as that home is actively for sale. Upon cancellation you forfeit any unused credits and any Remix, founding, or promotional benefits, and automated services (scheduling, done-for-you work, cross-promotion) stop.
"Your Content" means the addresses, photos, videos, descriptions, reviews, branding, and other materials you upload to or create in the service. You keep ownership of Your Content. You represent and warrant that you have all rights necessary to provide Your Content and to grant the license below, and that Your Content does not infringe anyone's rights or violate any law, MLS rule, or brokerage policy.
You grant Thunderbird Agency, LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, edit, adapt, create derivative works from (including AI-enhanced photos, virtual staging, reels, and Agent Spotlight videos), and publish Your Content and the marketing assets we produce from it, for two purposes: (a) providing the service to you, and (b) marketing your listings and cross-promoting them and you across the Best Home on Tour channels and network. You may request removal of specific content from Best Home on Tour promotion at any time by emailing us; removal does not affect assets already delivered to you or already distributed. This license ends when the relevant content is deleted, except for copies retained in backups or already published.
Parts of the service use artificial intelligence to generate and enhance photos, video, and written content. AI output can contain errors, alterations, or artifacts. You are responsible for reviewing and approving every asset before it is published or submitted to any MLS, and for ensuring it is accurate and complies with all applicable local, state, and federal law, MLS rules, brokerage policies, and Fair Housing requirements.
Enhanced or virtually staged images alter the appearance of a property. Where our system does not already apply a label, you must disclose virtual staging and any material image alterations (such as added furnishings, fresh paint, or a driveway vehicle) as required by your MLS and applicable rules. You are solely responsible for such disclosures.
You agree not to: submit unlawful, infringing, deceptive, or discriminatory content; use outputs in violation of MLS, brokerage, or Fair Housing rules; upload content you do not have the rights to (including third-party photos, video, or music); misrepresent a property; resell or sublicense the service; attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; or use the service to send spam or violate any platform's rules. We may suspend or terminate accounts that violate these Terms.
The service integrates third-party providers (for example, Stripe for payments, GoHighLevel for CRM and social posting, and AI providers for content generation). Your use of features that rely on those providers may also be subject to their terms. We are not responsible for third-party services, and their availability or pricing may change.
The service, software, templates, workflows, and the MaxMyListing and Best Home on Tour names and branding are owned by Thunderbird Agency, LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service and the deliverables we produce for you, for your own real-estate marketing. All rights not expressly granted are reserved.
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.
The service and all deliverables are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty regarding results, uptime, accuracy, or AI output. You use the service at your own risk.
To the maximum extent permitted by law, Thunderbird Agency, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost leads, lost sales, or lost data. Our total aggregate liability arising out of or relating to the service is limited to the amount you actually paid us in the three (3) months before the event giving rise to the claim.
You will indemnify and hold harmless Thunderbird Agency, LLC and its owners, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from Your Content, your use of the service, your disclosures (or failure to disclose) regarding image alterations or virtual staging, or your violation of these Terms or any law, MLS rule, brokerage policy, or third party's rights.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. If any provision is found unenforceable, the rest remains in effect.
We may update these Terms from time to time. Material changes take effect when we post the updated Terms and, where appropriate, notify you; your continued use after that constitutes acceptance. Questions? Email Support@AgentPowerups.com.
MaxMyListing works on its own. Best Home on Tour ("BHOT") is optional. BHOT is our cross-promotion network, and you join it only if and when you choose to — by "opening" it from inside your dashboard. Opening BHOT is not required to sign up for or use MaxMyListing, and it is never a condition of any plan. This section applies only if you open BHOT, and takes effect on the date you open it.
What you unlock. When you open BHOT, we may promote and elevate your listings and you across the BHOT network and its channels — which include our own social accounts and visual-discovery platforms such as Pinterest, where you generally do not post for yourself. The goal is added reach for your listings at no additional charge.
Media rights for BHOT use. Opening BHOT confirms and extends the license in Section 7 for BHOT-specific distribution: you grant Thunderbird Agency, LLC a non-exclusive, worldwide, royalty-free license to host, curate, enhance, adapt, publish, and schedule Your Content and the assets we produce from it across the BHOT network and its channels for the purpose of promoting your listings and you. As with Section 7, you represent and warrant that you hold all rights necessary to grant this license — including for photographs or video created by a third-party photographer, and that doing so does not violate any MLS rule, brokerage policy, or agreement you are under.
Leads & what happens when a listing ends. While a listing is active, leads it generates route to you, and its listing website and any connected vanity address stay live. When the home sells or your listing engagement ends, that web address may be converted into a lead-generation page that carries the audience and search presence built up while the listing was active. You may keep participating in that page — and keep receiving the leads it generates — by maintaining your membership on the terms we offer at that time; if you choose not to, we may operate the lead-generation page and retain the leads it produces. We will disclose the arrangement that applies before it takes effect.
Leaving BHOT. You can stop participating in BHOT, or ask us to remove specific content from BHOT promotion, at any time by emailing Support@AgentPowerups.com. Withdrawal is forward-looking: it does not undo assets already delivered to you or already distributed across the network, and it does not affect a lead-generation page already operating for a listing that has ended.
